Nov 2008 - Jaarlijks sterven er nu 2-miljoen Zuidafrikanen aan Turbo-AIDS - deze combinatie epidemie van AIDS+TBC vergt nu een al hoe hoger-wordend tol onder meestal zwarte Zuidafrikaanse vrouwen en meisjes die sterven aan medisyn-resistente TBC en Aids.
Maar Zuid-Afrika had miljoenen Euros tot haar beschikking van buitenlandse donors om deze epidemie terug te draaien. Helaas waren de Zuidafrikaanse leiders te druk bezig om zich te verrijken en letten dus niet op de manier waarop deze fondsen werden besteed...

Strict accounting demanded by the UN Global Aids Fund
NAIROBI, 4 November 2008 - PlusNews, the UN news agency, reports: The Global Fund to Fight AIDS, Tuberculosis and Malaria was formed in 2001 for the purpose of setting up an innovative approach to providing finance to combat the three diseases that kill more than six million people worldwide every year. Since its inception, the Fund has committed US$11.3 billion to 136 countries, about half of which has been disbursed.
The latest update from UN-AIDS shows that in 2007, southern Africa accounted for almost a third (32%) of all new HIV-infections and AIDS-deaths worldwide. And South Africa remains the country with the second-largest HIV-AIDS infection pool in the world: more than 6-million according to Medisines Sans Frontieres and 5.5-million says UN-AIDS.
Of course these UN-AIDS statistics already are very old: they date from 2006. And due to the country's rape-epidemic, it's especially the young, child-bearing age South African women who face the greatest risks of becoming infected with Turbo-Aids: women and girls account for around 90% of all the new HIV-AIDS infections in South Africa.
It's tiny land-locked Swaziland however, with about 1-million residents and below zero-population grate, which still has the world's largest pool of HIV-AIDS infected people -- 26% of the entire adult population says UN-AIDS...
Funding to beneficiary countries is based on performance, and failure to meet targets can lead to delays, suspension, discontinuation or termination of grants.
These are some of the countries that have fallen foul of the Fund's strict accounting procedures:
South Africa - In 2005, the Global Fund Board stopped funding for an HIV prevention programme. The Board decided that the grant, implemented by an NGO named loveLife, had failed to "sufficiently address weaknesses in its implementation".
Pakistan - In 2002, the Fund discontinued support for Pakistan's malaria projects because of weak project implementation, slow procurement of health products, poor data quality, and slow spending of project funds; according to reports, only 15 percent of insecticide treated nets were distributed during the specified grant period.
Ukraine - In 2004, the Global Fund temporarily withdrew grants worth $92 million to the Ukraine, citing "management issues". The grants were reinstated One and a half months later, when a new principal recipient, the International HIV/AIDS Alliance, was put in place.
Myanmar - In 2005, the global Fund discontinued grants worth $98.4 million after the government imposed temporary restrictions on travel and new procedures for reviewing the procurement of medical and other supplies. The Fund said at the time that the restrictions "prevented implementation of performance-based and time-bound programs in the country".
Senegal - In 2005, the Fund cut malaria grants worth $7.1 million over systemic issues that resulted inpoor performance. The Fund later approved a grant proposal for malaria projects submitted in Round 4.
Uganda - In 2005, the Global Fund temporarily suspended all five of its grants after a review by PricewaterhouseCoopers of one of the grants revealed evidence of "serious mismanagement" by the Project Management Unit in the Ministry of Health. The grants were worth a total of $201 million over two years, of which $45.4 million had already been disbursed. The health minister and his two deputies lost their positions and are on trial with several other government officials for charges relating to the misuse of Global Fund money.
Chad - In 2006, the Global Fund suspended its support after an audit uncovered evidence of misuse of funds and a lack of satisfactory capacity in the principal recipient and sub-recipients to manage the Fund's resources. The suspension was lifted in 2007 after a series of investigations and commitments from stakeholders to put better systems in place.
Nigeria - In 2006, the Fund decided to discontinue its Round 1 support for Nigeria's HIV/AIDS programmes, but awarded other HIV/AIDS grants in Round 5.
Kenya - In 2008, the Global Fund's Technical Review Panel (TRP) recommended that the Board reject Kenya's application for $300 million in Round 8. The government has not made public the reasons for rejection, but national media report that mismanagement and the misappropriation of money are the likely causes. The Minister of Health has put together a task force to trace and account for all money disbursed to Kenya by the Global Fund, and has called for suspension of the application in Round 9 until management glitches are ironed out. The government has experienced difficulties with its Global Fund proposals in the past: in 2003, $37 million was delayed after claims of corruption in the National AIDS Control Council.
Zimbabwe - In 2008, the Global Fund accused Zimbabwe of misusing $7.3 million of a $12.3 million grant, and asked for the money to be returned. In October, the TRP recommended that Zimbabwe receive some $500 million from Round 8. If the Board approves the money, it will be only the third time the country's proposal has been accepted - the government has frequently accused the Geneva-based agency of political bias in its approval of grants, which the Global Fund denies.
- Several other countries, including Namibia, Tanzania and Togo, have also had proposals for funding rejected in the past.
Countries can appeal a grant decision when a proposal has been rejected in two consecutive rounds.

Black SA judge ruled racially biased by SA Appeals court

Sept 19 2008. BLOEMFONTEIN. Black SA judge-president Frans Kgomo -- recently tipped for a post at South Africa's highest court -- has been formally rebuked by a full bench of the Supreme Appeals Court for his 'biased handling' of a racially charged murder trial in Prieska, the Northern Cape.
In fact, the Supreme Court of Appeal bench's judges were so disturbed by Northern Cape Judge-President Kgomo's hostility and prejudice towards the Afrikaner man he had found guilty of stabbing 13-year-old Biron Phetlo to death with a sword -- that it quashed the Afrikaner's murder-conviction and his 24-year prison sentence.
Became magistrate under apartheid-regime
Kgomo comes from Brits, north of Pretoria. He first worked as an interpreter and clerk in the former homeland of Bophuthatswana and was steadily advanced by the apartheid-era's justice system, eventually working his way up as a magistrate.
This decision by the Supreme Court of Appeals also will have widespread legal repercussions: Other decisions on his watch in the Northern Cape division would now, in light of this shock-judgment, also have to undergo high-level judicial reviews whenever Kgomo had resided: See some cases:

He also forced three northern-Cape schools to anglicise:
Kgomo had already shown his anti-Afrikaner bias in a previous ruling in Aug 2004 ordering three Afrikaans-medium schools to anglicise in one of the most Afrikaans-speaking regions in the country.
- The Kalahari High School and Seodin Primary School in Kuruman and the Noord-Kaapland Agricultural High School in Jan Kempdorp had challenged the provincial education department 's decision to force a small number of English-speaking pupils into their school, which effectively has now turned these schools into dual-medium educational facilities - and they lost their case thanks to the judge's decision.
The school's governing bodies had argued that it was their constitutional right to teach in the language of their choice - which indeed it is. They also argued that not enough resources - teachers, money and classrooms - to execute dual medium education successfully in this overwhelmingly Afrikaans-speaking, low-income region could be provided and that all the pupils' educational standards would suffer as a result of the high costs which would be involved.
However, delivering what he said was his final judgment, Kgomo proclaimed that the Afrikaans parents' evidence, submitted to his court, that only Afrikaans-medium schools were targetted by the local provincial education department, had been "wrong and over-simplistic."

He was preconceived, biased...
This week, five of the Supreme Court of appeal court's judges, led by Judge Nathan Ponnan, ruled unanimously that Judge Kgomo's approach to the Afrikaner defendant Joseph le Grange's murder trial was "certainly suggestive of one who has certain preconceived biases and allows those biases to affect his judgment".
Judge Kgomo, who was recently put forward by the Judicial Service Commission (JSC) has a possible Constitutional Court justice post and now serves as an acting Supreme Court of Appeal judge, had in their view, breached the most primary "canons of good judicial behaviour" and virtually taken over as a prosecutor, they said.
- The judges ruled that the state 'could reinstate charges against Le Grange, his son Pieter and his son's friend Hendrik van der Westhuizen', who were convicted as accessories after the fact to the murder, as long as Judge Kgomo did "not take part in such proceedings". It was the state's case that Le Grange had fatally stabbed Phetlo, a golf caddie, after he, his son and Van der Westhuizen had spotted the 13-year-old and his friend attempting to steal items from a sports shop.
- According to Phetlo's 14-year-old friend Curtis Maritz's testimony, Pieter le Grange accused the boys of having previously stolen from a local greengrocer.
Curtis said Phetlo tried to flee but was prevented from doing so by Joseph le Grange, who pinned the boy back with his "sword cane". Joseph le Grange then allegedly unsheathed the blade of his sword cane and stabbed Phetlo three times. Curtis claimed he had tried to get away to alert the police, but was prevented by Van der Westhuizen. He said the boys' three attackers then ran away.
- Joseph le Grange has always denied stabbing the boy, although he and the other two men did confront him over his stealing. His testimony was supported by his son and Van der Westhuizen.
The appeal court bench found this week that Judge Kgomo appeared "at an early stage to have made up his mind that the state witnesses were telling the truth and (the Afrikaners, Joseph le Grange and his co-accused) were lying".
He asked leading questions from the Bench to descredit the Afrikaners:
The appeal court noted that transcripts of the judge's cross-examination of the accused men was "replete with questions that were intended to discredit (the Afrikaner accused), compounded in many instances by disbelief and scepticism".
- The appeal court also criticised Judge Kgomo for his 'furious reaction' to the defence's suggestion that his little friend Maritz might have been responsible for Phetlo's death."On record there is absolutely no grain of evidence to remotely justify this suggestion," Judge Kgomo said. "All the accused have repeated this preposterous accusation in the reports to the social workers, the Correctional Services officer and the clinical psychologist.
"They did this despite my finding - showing why the accusation was absurd. I take a dim view of the fact that Curtis Maritz was accused by the accused of being the murderer. Counsel should not in good conscience have argued this point. I have no doubt that it is defamatory of Curtis Maritz and an aggravating factor against the accused," he had fumed from the bench...
According to the appeal court this week the judge's comments were 'not suggestive of an open judicial mind".
Thursday's ruling was not Judge Kgomo's first brush with racism and controversy. In 2006 he also ignited an acrimonious race row when he lodged an unsuccesful complaint with the JSC, demanding that judges Steven Majiedt and Hennie Lacock be axed for misconduct after they allegedly insulted him.
Kgomo will also be remembered for his judgements in two landmark cases dealing with same-sex equality.
The first case was Judge Kathy Satchwell who fought for the right of her same-sex partner to benefit from her pension payout. He declared this rule disallowing this as 'unconstitutional' and his judgment was confirmed by the Constitutional Court. The second case was of the famous SA sculptress and judge Anna-Marie de Vos, who successfully sought an order declaring that lesbian couples might adopt children. The couple won the case - apparently the first lesbian couple in the world to do so.

HOW UNBIASED HAS JUDGE NKOLA MOTATA'S JUDGMENT BEEN?
Judge Nkola Motata 's 'f*ck the Boer' curses aired in Johannesburg court-room
July 2 2008 - Wednesday, Johannesburg Magistrate's Court. Judge Nkola John Motata, charged with drunken driving and defeating the ends of justice, appeared in court to listen to three of five audio-recordings made at the scene of his car accident -- when he'd crashed his Jaguar into the wall belonging to English-speaking South African businessman Richard Baird's Hurlington home in January 2007.
The picture on the left was taken during Motata's Boer-hating rants that day. The recordings which were played in the courtroom were made by Baird on his cellphone during the altercation with Baird's tenant which had followed the crash.
- "We'll repair the damage, it's not a problem," the judge was heard telling businessman Richard Baird's tenant. "However, he [Baird] must not degrade me. No Boer is going to undermine me, f*** him. He mustn't insult me, f*** him, I don't care," Motata said in the recording Baird made on an I-Mate cellphone.
The judge had tried his very best to stop these recordings from being played at his trial, but the Pretoria High Court had dismissed his application to block them. Baird had made the recordings on his cellphone and then downloaded these clips onto his computer. Some of the recordings were in seTswana and seSotho and Magistrate Desmond Nair had to call in interpreters to translate.
- Motata, dressed in a black pinstripe suit, hardly looked up as he made notes. He's presently on paid leave.
He was charged with drunk driving and defeating the ends of justice after his Jaguar ran into the wall of Baird's property.
He denies he was drunk - and the reason he can do this is because he deliberately stonewalled and delayed being taken for blood-tests for a full two hours: the legal maximum time limit. Orders had also been issued 'from up high' to the local police not to arrest the belligerent motorist...
'THIS WAS THE WHITE MAN'S LAND, BUT IT ISN'T ANY MORE...' said judge Nkola Motata
Baird testified that Motata was clinging to his crashed Jaguar for support and 'could not stand by himself'.
Motata wsa heard to reply in his home-language, Sotho to Baird's suggestion that he was drunk, by saying to Baird's tenant that 'I will pay him for the damage, but he musn't undermine me. A Boer is not going to humiliate me. F*ck him, I don't care any longer. This was the white man's land, but it isn't any more.'
Motata repeats these kind of racist comments to Baird frequently.
At one stage, the white businessman was heard to reply: "That doesn't matter any more. I have black tenants and black neighbours. ' Then two black female metropolitan police officers show up to try and calm the judge down and convince him to go for a blood-test. He tells them: "Why are you standing behind the whites?'.

The site also features an 'advertisement' with pictures of white babies -- advocating their abortion as 'they're easier to kill before they are born'...
It also echoes the racist comments by ANC-parliamentarians that whites who whinge about crime, should just leave the country.

Oct 23 2008 - A series of boot-camp training sites for ANC Youth League members, designed to 'murder the cockroaches'... discovered in Eshowe, Kwa-Zulu Natal. This warning was issued by the Freedom Front Plus opposition party in an Oct 6 2008 press release. stating that the ANC Youth League has a large number of very young males, referred to as 'war-veterans', enrolled in several military training camps around Eshowe in KwaZulu-Natal.

As many as 500 youngsters - described as 'war veterans' but clearly youngsters who still were small children in 1994 - are training in several of these military boot-camps. The FF+ warned that this was a 'volatile sign', noting the growing political unrest in South Africa and noting the great many inciting statements made by ANC leaders such as Ancyl secretary-general Isaac Mahlangu's call for members to 'murder the cockroaches that stand in our way". Incendiary speech and personal abuse have become the languages of discourse of the ANC alliance - and not being nipped in the bud by the leaders
The Natal Witness warned this week that 'this reluctance to act upon that first breach of discipline and good sense may yet cost the ANC dearly. Recent attempts by ANC greybeards to put the genie back in the box have had no effect. That is hardly surprising. As any parent knows, children are adept at reading the subtle clues as to how far they can go. The children of the ANC have read the signals and know that they have an unspoken licence to run riot...'
The FF+ also warned that these sort of dehumanising descriptions of political opponents were very reminiscent of similar outbursts over the Hutu-radio stations during the horrible Rwanda genocide in 1994 - and warned that this was the result of 'years of muffled conflict and did not just happen on an impulse, it was well-planned...'
ANCYL leader Julius Malema also recently said the group 'would kill for (ANC Party leader) Jacob Zuma..." the FF+ warned in its statement, also noting that Zuma himself is infamous for his incitement to violence by singing 'Bring Me My Machine Gun' at rallies. It's very popular in black SA youth culture, seeing Zuma as 'a revolutionary who will bring the LAND resources back to its indigenous owners'....

War veterans aged seven?
"The ANC claims that these camps were erected for 'war veterans'. However, many of these "war veterans" where no older than seven in 1994... when ex-pres. F W de Klerk, as the last white leader of the apartheid government, had peacefully handed over hegemony to ex-pres. Nelson Mandela's tricameral coalition, comprised of the African National Congress, the SA Communist Party and Cosatu trade union movement..
The Freedom Front Plus expressed deep concern on behalf of the entire 3-million-strong Afrikaner white minority about these militia-training camps, warning that these point to 'hard evidence' that there are plans for an all-out genocide against whites as well as against black political opponents inside the ANC leadership for a Rwandan-style genocide referred to as Uhuru, and/or the 'Night of the Long Knives'. This is a strong belief amongst Afrikaners that the black majority is planning a pre-meditated genocide of all the whites in South Africa. ]
A comparable analogy can be made to the Rwanda Genocide, which was the result of years of muffled conflict and did not happen on impulse. During the early 1990s, South African blacks under the leadership of Nelson Mandela, also started singing songs similar to those heard during the Rwandan genocide, illustrating the danger closing in on white South Africans.
