Police-jail rapes of white SA men is a war crime pattern
It’s a pattern: often white South African men are arrested on frivolous charges, dumped in holding cells with black criminals and raped – and then released without charges the next day…
------------------------------------
The writer of the following article, known only as Sybille*, says these race-targetted rapes are ‘war-crimes’ – ‘acts of aggression to humiliate and degrade members of the white conquered tribe’.
------------------------------------
Sybille writes: “Gang rapes of white victims in holding cells in South Africa take place on a regular basis and are only reported when some of the victims sue the police and government. These gang rapes by black inmates in holding cells committed on solitary white victims, are in fact war crimes, acts of aggression in a sexual manner, under conditions of coercion intended to humiliate and degrade the victim, and has nothing to do with sexual gratification.
These white men (and at times also white women) are usually arrested on spurious charges. http://dienuwesuidafrika.blogspot.com/search/?q=sybille&max-results=60
Some are arrested for ‘speeding’, even though many deny they were in fact speeding. Some are arrested for ‘outstanding fines’.Most of the time, the ‘charges’ are dropped after they have been brutalised and gang-raped in police cells…
Some are arrested for ‘being witnesses to other incidents’, one was arrested for’ crimen injuria’which he denies took place. What they all have in common is that they were put in holding cells with large crowds of hardened black criminals who then proceeded to gang-rape them. Some of these men also reported that the black police egged these rapists on to rape them… to ‘teach the white man a lesson’.
Black African males in South-Africa view themselves as victors of a racial war, and view these white men as members of the conquered tribe.
Just some of the recently recorded cases:
“Wimpie, a white boy who was dabbling with dagga, is put in our cell. I don’t know how old he really is, perhaps 16 or more, but he looks no older than 14, with skinny arms and short, spiky-crowned, brown hair. He tries to fight, and so they hit him. His resistance stops abruptly when one grabs the back of his head and smashes his face into the steel bars ...The 20 men take it in turns to rape him. It goes on for more than eight hours, almost the whole night. The boy does everything he can, in his pathetic, limited range of action, to try to deter them, but he is ignored. He screams, he cries, he begs, he tries to bargain, he prays.”
“It is in the morning, though, that I am forced to see what life has coughed up before me. What’s left of Wimpie is lying in a corridor between the bunks, just in front of my bed. He is still naked, shivering in a pool of his own blood where they have discarded him. I will literally have to step over the small body to go and eat my breakfast.” http://upetd.up.ac.za/thesis/available/etd-11042008-164328/unrestricted/00front.pdf
- “This is a description by Gayton McKenzie, a hardened gang member, of the rape of a young white teenager only known as Wimpie. Where is Wimpie today? Probably dead of Aids, or suicide, as so many male victims of gang rape. If he is alive he might be homeless, addicted to drugs or alcohol as many who do manage to survive the experience. Their lives in ruins around them. “
“An unnamed diabetic man aged 52 from Primrose, Germiston is suing the minister of security for 4.3 million after being illegally arrested twice and being raped in police custody the second time. He was put into a detention cell with 30 black inmates at the Witbank police station. He described how four men carried him around naked in the cell while the rest sang and danced. The man became so emotional, the court had to wait for him to continue with his testimony. The inmates forced him to kneel over a rolled up mattress, then they proceeded to sodomise him until he later lost consciousness. The ‘case’ against him for which he had been arrested in the first place, was withdrawn.
In March 2008 in Polokwane (Pietersburg) a young local man named Nico Bouwer , left with his bride, was sodomised repeatedly while in police custody just a few weeks before he was due to get married. He’s since lost his job due to the emotional trauma, and delivers pizzas to stay alive and keep food on the table for his family. A fundraising effort was launched by Rapport newspaper to help pay his medical bills. Bouwers life is totally in ruins after the attack. Mr Bouwer was on his way home from a friend’s house when his left tyre burst and he hit a light pole and a stoplight. He was taken by ambulance to the Polokwane hospital where he was arrested, and despite being injured in the accident taken to holding cells. He demanded his rights to a phone call but was turned down. In the cell were 25 black inmates. Eight of these black men attacked Bouwer and repeatedly raped him. Some held his arms and forced his face into a pillow while they were sodomising him. He was only allowed to call his lawyer the next day when he was finally released on bail.
In Vryheid, game rancher Etienne van Wyk was being sodomised in a police cell while the inmates were singing, the Pietermaritzburg High Court was told. Van Wyk claimed R1.2m from the Minister of Safety and Security. Van Wyk and Duvenhage were put into the Hlobane police cells after they were arrested for ‘transporting Van Wyk's game animals without a licence”. The suspects in the cells charged with the rape were all hardened criminals predisposed to violence. The farmer did have a license and was released without charges the next day. http://www.iol.co.za/index.php?from=rss_Crime%20And%20Courts&set_id=1&click_id=15&art_id=nw20081022161312112C310054
On August 10, 2003 a white Cape Town businessman was sodomised in the police-holding cells at Wynberg magistrate’s court. He later sued the state for damages. The 57 year old professional was arrested and and held in a cell at Claremont police station over a weekend and later transferred to holding cells at Wynberg for his bail application. At Claremont “I was in a cell with a man who screamed at me non-stop that I was a f…ing (wit vark) white pig, I was terrified. After being transferred to Wynberg the man said as soon as the doors to his cell closed he was attacked by a group of men, some armed with knives, who pulled his clothes off and sodomised him. There were about 30 people in the cell and once the door was slammed shut you couldn’t see in or out. There was nothing I could do. All these guys were holding me down. I had no chance. “Your life just basically goes for a ball of shit. I’ve always been a placid person but nowadays I just scream and shout. In 18 years, my partner and I never had a fight, but now everything has changed. “ The man, who is self-employed, said he couldn’t tell anyone what had happened to him in the cell, but he was haunted by the incident.” The ‘case’ for which he had been arrested was dropped. http://www.iol.co.za/index.php?set_id=1&click_id=13&art_id=ct20030810102700658M610984
Whites dying in police custody:
13 July 2008 -
Picture: Alzheimer sufferer James Frederick Brown, 69 , left, was overwhelmed by an angry black mob at a Kriel supermarket after the confused old Afrikaner had forgotten to pay for a chocolate bar. He was taken intact to a Kriel police cell without any apparent injuries. Yet despite repeated attempts by relatives to explain his medical condition to the police -- and to try and get him out of the police holding cell and released into their custody, this defenceless old man was found beaten to death the next morning with these fresh, hook-shaped head wounds and other bruises to his face. http://cid-b6b44a5376348175.skydrive.live.com/self.aspx/Kill%20the%20Boer%20Kill%20the%20Farmer%20victims%20trauma%20album/Brown%20James%20beaten%20to%20death%20at%20Kriel%20Police%20station%20Alzheimer%20sufferer%20SA.jpg
‘Teach the white man a lesson’ – police told the criminals in the holding cell:
Peter Wheeler murder in Grabouw cell – Like James Brown, building contractor Peter Wheeler also was murdered in a police cell - kicked and beaten to death while in custody in Grabouw. According to reports the arresting police officers had even told the black criminals from Pollsmoor Prison who were in the same cell waiting to attend their trials the next day, to “teach the white man a lesson.”
Deaths in South African police custody rose to 912 in 2009
Cape Town – Deaths in police custody rose to 912 in 2009.. This is according to a press release on 26 September 2009 by the Independent Complaints Directorate. But the ICD says while these deaths had risen “from 791 the previous year’ , this fact “could not be read as a sign of an increase in police misconduct”. The directorate’s Francois Beukman says when considering the cases carried over from the previous year, the ICD had just more than 11,190 cases to deal with. According to the Mail and Guardian of Feb 13 2008, More than 800 KZN cops were under investigation for crimes ranging from assault through to rape and murder.

sources, court transcripts, original news reports:
22 Oct 2008 – trial.Accused rapists of Vryheid game rancer Etienne van Wyk A Vryheid game rancher was being sodomised in a police cell while the inmates were singing, the Pietermaritzburg High Court was told on Wednesday. They presumably did so to drown the victim's screams, presiding judge Nic van der Reyden said.Game rancher Etienne van Wyk is claiming R1,2-million from the minister of safety and security.Van Wyk was put into the Hlobane police cells along with farm manager Zacharia Duvenhage. They were arrested for allegedly transporting Van Wyk's game animals without a licence. Duvenhage was not sodomised but was assaulted and he is claiming R350 000 from the minister.Their counsel, advocate Gerrie Roberts, SC, said the acting police station commander was asleep and was not woken by the screams of Van Wyk while he was being sodomised. Van Wyk and Duvenhage were first put into a cell on their own.Three women suspects were later put into this cell, and Van Wyk and Duvenhage were transferred to a cell with 14 (black male) occupants.Evidence given was that they could have been held in other cells, the magistrate court cells or taken to other police stations. The 14 inmates included suspects charged with violent crimes, including a man charged with three murders and an arson, and six men charged with rape. Both Van Wyk and Duvenhage have given permission for their names to be used in the media. The minister is contesting their claims.Roberts said because the police station commander did not respond to Van Wyk's screams the inference was that he was asleep.Other policemen did not respond to the screams either.Roberts said that prescribed hourly inspections of the cells during their incarceration were not made. The Vryheid district surgeon, Dr Senta Klingenberg, told the court that there was evidence of repeated penetration of Van Wyk. She said that Duvenhage had two bruises on the head and on his back. Roberts said that Van Wyk was sodomised about 3am by one or more inmates while others broke into song. Van der Reyden said this was a ruse used by prisoners to mask the sound of a bar being sawn through or any similar incident.Roberts said that Van Wyk managed to phone his wife who contacted the investigation officer in the game transport case. The investigation officer went to the station and found the gate locked. He phoned the station's number and heard a phone ringing in the charge office, but no-one responded. He sounded his vehicle hooter but there was no response and he climbed the locked gate and went into the charge office where he found the commander, an Inspector Mtshali, asleep at 3:55am. He took Van Wyk and Duvenhage to Klingenberg. She found tears, blood and bruising, indicating repeated penetration. The former commander of the police station, Superintendent Isobel Weiss, told the court that assaults had been perpetrated in the cells and the policemen must have known about them. She said that whenever inmates were singing cells should be inspected because "something could be up".Roberts said that no cell inspections were carried out in the hours before the rape. She would not have put suspects charged with the type of offence allegedly perpetrated by Van Wyk and Duvenhage in a cell with violent criminals. http://www.iol.co.za/index.php?from=rss_Crime%20And%20Courts&set_id=1&click_id=15&art_id=nw20081022161312112C310054
July 11 2008 Alzheimer sufferer James Frederick Brown, 69, found dead in Kriel police cell for 'stealing' chocolate worth R8,50... "Kill him, kill him,' screamed the Shoprite cashiers as the mob carried the frail old man out, with children punching him from below...Jul 11 2008 Kriel. Afrikaner Alzheimer sufferer James Frederick Brown, 69, couldn't even remember whether he'd paid for a bar of chocolate -- but he was set upon on Tuesday at the Shoprite supermarket in Kriel by a security guard -- and then attacked by a vigilante mob, which was egged on by screaming cashiers yelling 'kill him, kill him'', while they were carrying the sick old man out of the shop, punching and kicking him. KRIEL SHOPRITE address:Corner Andre & Brownwyn Street, Kriel, 2271 South Africa Tel: +27 (17) 648 9500 Fax: +27 (17) 648 9504. An elderly eye-witness -- too terrified to provide a name -- described how a large mob had dragged the sick old white man out of the shop - 'children were even beating up on him from below'. "It was horrid. Even the cashiers added to the hysteria by screaming that the old man had to be killed if he wants to steal chocolates.' Brown's daughter Rose-Marie Steyn said the old man had wandered from their home at around 12:30 from their home in Springbok Avenue, something he did often. "Everybody in our neighbourhood knew of his confusion caused by his Alzheimer's. We started worrying when he didn't come home at around 13:30,' she said. A hairstylist working nearby then phoned her husband Willie to let them know that the old man had been arrested for theft."We spent all afternoon at the police station trying to see him but the police refused, claiming he was 'aggressive' and should rather sleep.' "We told the police that he is an Alzheimer's sufferer but they refused to listen,' said his wife Rosa Brown. "A policeman even told me that he was keeping his gun on him because James was so wild.' They insisted that he be kept in the cells until 18:00."When we finally went to fetch him Willie went along to calm my dad down,' said Mrs Steyn. The horrified familyfound the old man lying on his back on the floor of the dark cell, in a large puddle of blood. The police on the scene claimed he 'd probably 'fallen in the cell and hit his head'. Local doctor Leon Pelser immediately was called in to examine Mr Brown in the cell with family present.Dr Pelser said: 'it was so dark that I had to ask a policeman to turn on his flash light so that I could try and revive Mr Brown. Under these most horrid circumstances I opened up his airways with a pipe and massaged his heart, but to no avail. I entered the cause of death as 'unnatural'. "I examined him very thoroughly because I knew there will be an inquest.' Police superintendent Abie Khoabane claimed in his comments to Beeld newspaper that Brown 'already had blood on his face and his clothes when the (shop's) security guards handed him over to the police.' However he himself wasn't there at the time - he 's just the police spokesman for the province. Dr Pelser said he'd found wounds to the old man's right-eye, his nose and chin, and a large hole in the back of his skull. How he came to get these wounds will have to be established by an inquest.Beeld cited Mrs Sonto Mlotshwa, the manager of Kriel Shoprite - claiming that the old man had been "arrested for theft'. She didn't know a thing about the way he was assaulted by the mob during this 'arrest' although she must have been present, and the security guards wouldn't say a word either. And Shoprite's management are also stonewalling: they were unable to comment as to how a confused old man with Alzheimer's ended up being arrested and assaulted by a howling mob of shoppers, being encouraged to 'kill him' by screaming tellers - just because he couldn't remember whether he'd paid for a R8,50 bar of chocolate or not. Brown's family are besides themselves with anger. "How can they do this to an old, sick man? He didn't deserve this. His illness made him difficult at times, but he probably just forgot to pay,' his daughter wept.http://neultra.blogspot.com/2008/07/alzheimer-sufferer-james-frederick.html
DiĂ© man het padgegee toe ’n polisiebeampte by die sel verbystap. Peter Jordi, prokureur by die Wits-regskliniek. Maar as dit gebeur kan die polisie aanspreeklik gehou word. Hy sĂȘ die polisie is veronderstel om selle gereeld te inspekteer. In 2005/2007 is 285 mense in polisie-aanhouding dood. In 2006/2007 was diĂ© syfer 248. In Julie verlede jaar is mnr. Bouwer se telefoonnommer is 079 600 8744 http://www.news24.com/Rapport/Nuus/0,,752-795_2284569,00.html
Cape Town businessman sodomised in Wynberg court police holding cells A Cape Town businessman, who claims to have been sodomised while in the holding cells at Wynberg magistrate's court, is suing the state for damages. The 57-year-old professional, who prefers not to be identified, said his ordeal started when he was arrested late last year on a trumped-up rape charge, of which he was later acquitted. He was held in a cell at the Claremont police station over the weekend before being transferred to the holding cells at Wynberg Magistrate's Court for his bail application and put in a cell with prisoners from Pollsmoor Prison. The man claims that as soon as the doors to the cell closed he was attacked by a group of men, some armed with knives, who pulled his clothes off and sodomised him."There were about 30 people in the cell and once the door was slammed shut you couldn't see in or out," he said."All I could see was this one guy with thick gold chains round his neck. He was the first to grab me and flipped me on to my back. Then a whole group of men pulled off my trousers and sexually assaulted me." The man said he couldn't say exactly how long the attack lasted - all he remembered was the screaming and shouting of the men. "There was nothing I could do. All these guys were holding me down. I had no chance." He said when the cell door eventually opened he managed to get to a policeman and tell him what happened. "I was then put in a cell with one other prisoner." The man, who frequently broke down in tears during the interview with Weekend Argus, said his life had all but been destroyed by the attack. "I see a psychologist once a week to try to cope, but I don't sleep. When I eventually do, I wake up and I'm back in that cell."He said he had been too traumatised at the time to even go for an Aids test although he was being treated by a doctor for stress. "Your life basically just goes for a ball of shit. I've always been a placid person but nowadays I just scream and shout. In 18 years, my partner and I never had a fight, but now everything has changed."The man, who is self-employed, said he couldn't tell anyone what had happened to him in the cell, but he was haunted by the incident."There is nothing in my life that doesn't remind me of what happened, be it a newspaper report or watching a movie - it all just comes back."He said the Claremont police cells had also been a nightmare."The cells are so far away from the charge office that it is impossible for anyone to come to your aid if you are in any trouble."I was in a cell with a man who screamed at me non-stop that I was a fucking wit vark (white pig). I was terrified." His lawyer said the case would not only be about compensation for his client, who was suffering from post-traumatic stress, but was also to make sure the police provided proper protection for those in their custody and treated them according to basic human rights. The Claremont police station is being investigated by the South African Human Rights Commission and the Child Protection Unit following the gang rape and assault of three young boys in custody there. http://www.iol.co.za/index.php?set_id=1&click_id=13&art_id=ct20030810102700658M610984
July 2007, Peter Wheeler, 55, Middelburg, beaten, kicked to death in Grabouw police cells after he had been arrested for alleged ‘drunkenness’. http://www.news24.com/News24/South_Africa/News/0,,2-7-1442_2284864,00.html
Diabetic man, 56, raped in Primrose police cell 5/06/2008 A white man, 52, cried in the Pretoria High Court while he told how inmates in a police cell raped him.The man, a diabetic from Primrose, Germiston, is suing the Minister of Safety and Security and the Minister of Justice for R4.3m in damages. He claims he was twice unlawfully arrested and that after the second arrest, he was raped in police cells. He testified how he was arrested on February 28 at the magistrate's court in Witbank when he only wanted to fetch a copy of his charge sheet. According to him, he was kept in a cell along with 30 fellow prisoners in the holding cells at the Witbank police station. He told how he was carried, naked, around the cell by four men while the rest sang and danced. The court had to be adjourned before the emotional man could continue testifying. "The singing and foot stamping became louder," he said.He described how of the prisoners took one of the green mattresses in the cell, rolling it up lengthwise and put it in front of him. He was told to kneel down over the rolled up mattress."The intensity of the singing and dancing reached a climax". The men started raping him. "I must have lost consciousness then. When I came to, they were still busy". They later stopped and ignored him for the rest of the two days that he was kept locked up with them in the same cell.He was taken to court where bail was set for R1 000. But he could only call someone to bring him the money a day after his court appearance. He also had to be taken to hospital as he had not been able to get his diabetic medicine while being in custody. The man said he asked the doctor to admit him because he was scared of going back to the cell. July 27 2002 - secret film of ‘Wimpie” – 14-year-old Afrikaans boy's gang-rape by 18 prison inmates in Bloemfontein Grootvlei prison, official sacked for refusing to destroy film on order of ANC-regime: Prison officials were buying arrested youths from cops and selling them as sex-slaves to prison inmates -- Secret film exposes South African jails - Warders trade in sex, drugs and weapons, inquiry told - Chris McGreal in Johannesburg The Guardian, Saturday 27 July 2002 - The South African prisons department has been forced to reinstate a governor who was sacked for resisting official pressure to destroy a secretly made video showing warders selling convicts weapons, drugs and juveniles for sex. Tatalo Setlai, the governor of Grootvlei prison, was sacked after the court presentation of the video to a judicial inquiry laid the ground for weeks of astonishing and at times horrific evidence about the scale of the corruption and abuse in jails. More than 20 warders are now under investigation. One is accused of rape, another of making £600 a month smuggling brandy to inmates. The video was made by four prisoners at the jail in Bloemfontein over a five-month period. Using miniature cameras, the four - two murderers, an armed robber and a cattle rustler - filmed in their cell, the prison kitchen, and parts of the jail where warders sold drugs and alcohol to convicts. Two particularly disturbing scenes stunned the inquiry, and, after the video was shown on television, the public. One showed a warder selling a pistol and a bullet to a double murderer for about £400, for use in an escape attempt. The other caught a guard bringing a (white) juvenile inmate into the cell for sex with another prisoner. The video opened the floodgates for evidence by youths who told how they were regularly auctioned by warders to older inmates for sex. Several accused a senior warder, Sam Mohanoe, of having raped juvenile prisoners since 1985. One, Wilson Mohodi, said on Monday that Mr Mohanoe ran a "soccer club" for young inmates who were all forced to have sex with him. He said the guard rewarded the young men with marijuana, toiletries and petroleum jelly. "When [Mohanoe] needed a young man, he gave me dagga [marijuana], and I gave him a young man," Mohodi told the commission. "Sometimes, after he had finished with a young man, he would call me and I would also have intercourse in his office." The commission also heard this week that one juvenile, unable to afford the £36 bail while awaiting trial for theft, was raped 11 times and twice tried to commit suicide. "I don't accept myself as a human being anymore," the youth told the commission. prisoner the youth identified as one of his rapist, Japhta Moeng, admitted that there was a trade in young inmates for sex. "Juveniles are sold there. If he was sold, what can I do?" Moeng said. Turning to his victim, he added: "If I did sodomise you, I did it because you were sold by somebody else to me." Other prisoners have told the commission of lesser abuses: one was forced to give a senior prison official a pedicure and cut his corns. A female prisons commissioner said she was forced by armed warders to kneel, and was spat on and called a bitch, because, they said, it was against tradition for a woman to stand in front of men. One man complained to the commission that a fellow convict, jailed for impersonating a doctor, was treating prisoners in the jail hospital. Gayton McKenzie, the prisoner who organised the videotaping, said he was responding to President Thabo Mbeki's declaration of 2002 as the "year of the volunteer". The convicts handed the video to the prison governor, Mr Satlei, who told the inquiry that he regarded it as an important step in eradicating abuse and corruption by his staff. Officials in the prisons department had different ideas, however. Mr Setlai said that the provincial correctional services commissioner, Willem Damons, asked him to destroy the tape. "He said it would damage the image of the department, the government and the country as a whole, and drive investors away." The minister of justice, Penuell Maduna, came to the governor's defence after a prisons commissioner, Linda Mti, said he should be suspended, but he was removed from his post and appointed to the parole board. Mr Setlai was reinstated at Grootvlei on Tuesday after he had threatened legal action and the chief counsel at the judicial inquiry had accused Mr Damons of constructing a "tissue of lies" about him. The commission heard that Mr Damons blocked the arrest of the accused warders, who are still employed by the prison service. The four prisoners who recorded the video said they were stripped of their privileges and locked in their cells for 23 hours a day as punishment. Another, a member of one of the notoriously violent prison gangs, told the inquiry that a "death sentence" had been passed on the four at the behest of some warders. One of the four, Samuel Grobbelaar, said two attempts had already been made to kill him. He was knocked unconscious with a steel rod and had his food poisoned while he was recovering in hospital.

Enormous shark tears apart Congolese tourist in Fish Hoek – police issues shark-alert
2010-01-12 – A tourist from the Congo was torn in two near the Cape Town resort of Fish Hoek by an ‘enormous shark’. A shark-alert has been issued. The Cape Argus reports that ‘the man who had been on holiday in SA for a month, but could not be identified as most of his relatives had not been informed.” A woman, believed to be his wife and who was at the beach with him, had been taken away from the scene and given trauma counselling.Fish Hoek resident Gregg Coppen witnessed the attack from his home near the beach. Cape Town's disaster management warned bathers to be on the lookout for Great White sharks which traditionally cruise that stretch of the coast for a nibble at this time of year. "The appearance of White sharks is normal during peak summer months in Cape Town near in-shore areas, as these sharks are known to hunt and feed along this stretch of coastline at this time of year," spokesperson Wilfred Solomons-Johannes said on Tuesday. The sharks have not been seen coming close to the beaches or near swimmers. Shark spotters have seen them along the False Bay coastline between Sunrise Beach and Fish Hoek. also: Man fights with shark during attack Shark nibbles man’s foot

Jail rapes of white South Africans is a war crime
Written by Sybille. Gang rapes of white victims in holding cells in South Africa take place on a regular basis and are only reported when some of the victims sue the police and government.
Some of these men also reported that the black police egged the rapists on to rape them…
Black African males in South-Africa view themselves as victors of a racial war, and view these white men as members of the conquered tribe.
Recorded cases:
I will literally have to step over the small body to go and eat my breakfast.”
- This is a description by Gayton McKenzie, a hardened gang member, of the rape of a young white teenager only known as Wimpie. Where is Wimpie today? Probably dead of Aids, or suicide, as so many male victims of gang rape. If he is alive he might be homeless, addicted to drugs or alcohol as many who do manage to survive the experience. Their lives in ruins around them.
A Diabetic man aged 52 from Primrose, Germiston is suing the minister of security for 4.3 million after being illegally arrested twice and being raped in police custody the second time. The ‘case’ against himfor which he had been arrested in the first place, was withdrawn.
Polokwane (Pietersburg) – a local man who was sodomised repeatedly while in police custody lost his job, due to the emotional trauma, and deliver pizzas now to stay alive and keep food on the table for his family. His life is totally in ruins after the attack. In the cell were 25 inmates. Eight of these black men attacked Bouwer and repeatedly raped him. Some held his arms and forced his face into a pillow while they were sodomising him. He was only allowed to call his lawyer the next day when he was finally released on bail. His medical bills were in the thousands of Rands.
Vryheid – A Vryheid game rancher was being sodomised in a police cell while the inmates were singing, the Pietermaritzburg High Court was told on Wednesday. Game rancher, Etienne van Wyk, is claiming R1.2m from the Minister of Safety and Security. Van Wyk and Duvenhage were put into the Hlobane police cells after they were arrested for transporting Van Wyk's game animals without a licence. The suspects in the cells charged with the rape were all hardened criminals predisposed to violence.
A Cape Town businessman was sodomised while in the holding cells in Wynberg magistrate’s court. He later sued the state for damages. The 57 year old professional was arrested and and held in a cell at Claremont police station over a weekend and later transferred to holding cells at Wynberg for his bail application. At Claremont “I was in a cell with a man who screamed at me non-stop that I was a fucking (wit vark) white pig, I was terrified.
- “Your life just basically goes for a ball of shit. I’ve always been a placid person but nowadays I just scream and shout. In 18 years, my partner and I never had a fight, but now everything has changed. The man, who is self-employed, said he couldn’t tell anyone what had happened to him in the cell, but he was haunted by the incident.” The ‘case’ for which he had been arrested was dropped.
Then there are some who never leave these holding cells alive. Like Peter Wheeler a building contractor who was kicked and beaten to death while in custody in Grabouw. According to reports the police told the black criminals in the cell to “teach the white man a lesson.”
Deaths in police custody increased by 15% – press release 26/09/2009
Cape Town – Deaths in police custody rose to 912 in the past year. This is according to the Independent Complaints Directorate. But the ICD says though the figure “was up from 791 the previous year’ , it “could not be read as a sign of an increase in police misconduct”. Somalis flee to Riviersonderend police station after attacks on shops
12 January 2010 Residents go on rampage after man's death Western Cape police fired rubber bullets to disperse about 400 Riviersonderend residents who went on a rampage, attacking and looting shops owned by Somali nationals. ”Residents were angry because police had found a body of a 20-year-old in the bushes. The man was reported missing in December and was last seen with Somalis," Inspector November Filander said on Tuesday. The residents mobilised and submitted a
request for a march, but the municipality denied them permission. Residents went ahead anyway and police intervened when the march turned violent and the locals started looting Somali-owned shops at 8pm on Monday. Police fired rubber bullets at the crowd, injuring one person. A 30-year-old woman was arrested for public violence. About 20 Somali nationals fled to the local police station for refuge.Police managed to calm the situation down at 10pm and they kept a strong presence in the area, securing shops owned by Somalis. Police denied that the attacks were in any way, shape or form ‘xenophobic’. http://www.capetimes.co.za/?fSectionId=&fArticleId=nw20100112132112508C310744

12 January 2010 - Matric success... and days later he's dead
Just days after celebrating her son Jermaine Vermeulen's matric pass, a grieving Flats mom is planning his funeral. Jermaine Vermeulen, left on the front page of the Cape Times next to his grieving parents, was supposed to enrol at a computer college but instead his family were identifying his body in the morgue and preparing his funeral. The 18-year-old was stabbed in the neck while fetching milk for his parents, Felicity and Roland Vermeulen, on Sunday evening. His murderer tried to steal his cellphone and stabbed the teenager in the throat. Speaking from the family's home in Birdwood Street, Athlone, his aunt Amanda Vermeulen, 39, says his death came as a shock to the whole family. "He was never involved in gangs or gang-related activities," she says. http://www.capeargus.co.za/?fSectionId=3571&fArticleId=iol1263293482177M362 Police have also stepped up patrols after Mitchell’s Plains killings.

'Intersexual drug-dealer suspect wants to kill himself after cops discover his secret’
January 12 2010 The mother of a man born with both male and female genitals says cops have left her son's life in ruins. Suspected Mitchell's Plain drug merchant Fadwaan "Vet" Murphy, 36, has been sleeping in his car or at a relative's home since police accused him of identity fraud for allegedly owning two identity books. Murphy's mother Faeeza Allie, 59, says her son is longing to be back home with his beloved wife Shitara and their baby son.Faeeza says she is worried sick about her son after discovering that he was sleeping in his car in front of a centre for abused women. "He can't go home because he is afraid the police will frame him because they have access to his home in Kuils River," she says. "And he can't come visit me here in Eastridge in Mitchells Plain because the infamous, deadly Dixie Boys gang will be on top of him. "My son loves his wife and he is very stressed out about his marriage because it is not stable at the moment." Last week, Murphy was granted R300 bail at the Blue Downs Magistrates' Court after being charged with bribery and the possession of gun magazines. Police claim Murphy bribed a cop with R9 100 to stop him from being strip searched inside his Kuils River home. Mitchells Plain Station Commander Jeremy Veary says police discovered a prosthetic penis around Murphy's waist during the search. Now Faeeza says her son feels worthless after having his personal life and marriage laid bare in public.
"He wants to take his own life and I'm very worried about him," says Faeeza. "On Sunday he managed to spend time with his son and uncle and now I don't even know where he is." Faeeza says her only hope at giving her son his life back will be a photo of him as a little girl. She hopes the photo will prove Murphy's story that he was raised as a girl and later chose to become a man at the age of 13, reports the Daily Voice… http://www.iol.co.za/index.php?set_id=1&click_id=13&art_id=iol1263293607752V356

Jan 12 2010 - Kitty Botha, 83, murdered in Lyttelton, Pretoria – for nothing…
‘God Does Not Sleep,’ … read her note, left, which the murdered Afrikaner widow Kitty Botha had stuck to the wall of the torched
Lyttleton, Pretoria home…
Gauteng province -- Herman Eloff of Beeld newspaper reports from Lyttleton in Pretoria that 83-year-old Afrikaner widow Kitty Botha, left, was at home with her beloved dachshund when the security gate around her cottage was torn down by attackers -- who then killed them both. The attackers then plundered her belongings and torched the house. She was one of the old-time residents of Lyttleton and lived in this house for 55 years.
Kitty Botha’s house was torched after she was murdered. However, her Bible and the many religious notes which the deeply devout widow had stuck to the wall, such as ‘God does not sleep’ (God slaap nie”, left) were left relatively unscathed in the fire which her murderers had started…
Her grandson Ryan Botha said the neighbours still tried to douse the fire with garden hoses when they saw the smoke at around 20:30 while emergency services were rushing to the scene. The emergency personnel found the old woman’s body in the hallway with her little dog. Kitty Botha had lived in this house for 55 years - 27 years by herself.
She was overpowered, tied up, strangled and beaten to death in her house, after which the attackers set fire to it - for nothing. The hands of eighty-three-year-old Kitty Botha - or tannie Kitty as she's known - were tied up, and a rag stuffed in her mouth. Her grandson, Ryan Botha, 26, said according to the autopsy report, his grandmother died of head wounds.
"There were also marks on her face. Her body was found in her house in Selborne Avenue, in the hallway, in front of the room where the fire was started. She was partially burnt." Tannie Kitty's Dachshund, Moomoo, presumably went to hide behind the couch during the attack on Friday night, where he smothered to death due to the smoke. "This is the third time that there's been a break-in at my ouma's house, but the first time that she was attacked."
Botha, who'd been visiting his grandmother a few hours before the murder, said the attackers probably struck between 19:00 and 21:30, since she spoke to her daughter, Elna Botha, on the phone just before 19:00.
‘Tried to get gran's guns’
The attackers ransacked the entire house. "The content of every drawer and cupboard was thrown out. "They also tried to open the safe which contained my ouma's firearms, but failed. Then they started the fire in the room next to my ouma's bedroom and fled." According to him, nothing was stolen.
Grandson Botha, left looking at the notes written by his gran and stuck to the wall of her house, said that the neighbours heard a loud noise when a window burst due to the heat. They went to the house to investigate. "The neighbours tried to put the fire out with their garden hoses.
“A policeman who happened to drive by the house tried to go inside to look for my ouma, but the flames and smoke were too overwhelming." The fire brigade arrived shortly thereafter and was able to put the fire out before it spread throughout the entire house.
'Nothing but love to give'
Botha said his grandmother was probably one of the oldest residents in Lyttleton. "She lived in that house for 55 years. The greatest part of the last 27 years, after the death of my oupa (Johan Botha), she lived alone. "My ouma was an amazing woman. She was very religious and had nothing but love to give."
Bible verses and messages of love and peace, dotted on the walls throughout the house, testify of tannie Kitty's faith.
"She was a strong person, but didn't stand for any nonsense, and I believe she gave her attackers a stern talking-to. I hope they read the messages on the wall and that it bothers them so they may repent."
Botha says he isn't bitter about what happened. "If I didn't know the Lord, I would have held a grudge." Lynette Erasmus, police spokesperson, said the police have not been able to find any sign of a break-in. Police are investigating a charge of murder and arson. They didn’t arrest anybody thus far.

2010_1_10 Charles and Violet Engelbrecht of Vaalharts North Cape, cruelly attacked
January 12 2010 -- Hartswater, VAALHARTS, North Cape – Elderly Afrikaner farm couple Charles and Violet Engelbrecht, 73 and 71 of plot 2K11 in Magogong were attacked by seven armed black men on Sunday January 10, 2010 at around 21:00 and brutally mauled, reports Jana Engelbrecht in Volksblad newspaper.
Mr Engelbrecht was assaulted with drying-hooks, hammers and large tongs, while his wife was dragged around with hooks, threatened with rape, tied up and held hostage inside the homestead for several hours.
Mr Engelbrecht suffered a cracked rib, broken nose and severe bruises all over his body and face. He’s recovering at the local Jane Keyer clinic.
Engelbrecht, who farms with pecan nuts, grapes and citrus in this arid northern Cape region, told the journalist that he had noticed that four cats had died on the property on Sunday – which he found strange as their Labrador dog also didn’t want to eat.
“They probably were poisoned,’ he said. He noticed the dead animals while seated on his tractor, spraying a pesticide on the pecan trees, but when some of it had blown onto him he rode the tractor into the packing store and climbed off, intending to go and take a shower to wash it off. Just then his smaller dog started barking.
The farmer took a large flashlight to investigate when a large group of men wearing balaclavas stormed towards him, forced him to the ground and started beating him ferociously, he said.
He tried to fight back with his heavy flashlight and did get in a few blows before he lost consciousness, he said. When he woke up he was tied up and two of his attackers were sitting next to him. “I was worried about what was happening at home but couldn’t do anything. I couldn’t move.’ They then loaded him into his bakkie and dumped him in the pecan-nut orchard, he said.
Meanwhile Mrs Engelbrecht was attacked inside the television room and was forced to open up the safe. “They got really frustrated when they discovered so little money in the safe. They told me there should be money and took me to the bedroom, saying that they were told that the money was there. They threatened to rape me, with one telling me he had AIDS. I then decided ‘they can go vrek’’told them I was 70 years old and will die soon anyway,’ she said.
Violent Engelbrecht said she was calm throughout her ordeal, even though they were dragging her around the house with a lucern-hook. She gave them the credit cards and the PIN_numbers and they tied her to a chair in the TV room.
She realised after a while that the men had left after she crawled to the front door to lock it. She locked the bedroom door and pushed the alarm constantly, she said. A neighbour found her while other neighbours started searching for Mr Engelbrecht, where he was found at around 01:00 in the pecan-orchard.
Agri-North Cape president Wessel van der Merwe said the criminals who had committed these loathsome crimes must not get any mercy from the justice system. “No parole, no bail and they must get the maximum sentences,[‘ he said.
The North Cape MEC for agricultural affairs, Lerato wa Modise, issued a statement through his spokesman Norman Shushu which also confirmed this viewpoint: he said ‘criminals who attack farmers must be punished for their deeds.’ het gesĂȘ misdadigers wat boere aanval, moet vir hul dade boet.

Gruesome meathook murders of Van Zyl couple; Senekal farmers ask: “where are the news media whenever farmers are murdered?’
9 January 2010 SENEKAL, FREE STATE.More than 100 upset Free State farmers protested outside the Senekal magistrate’s court during the first appearance of two black murder-suspects who were arrested for the gruesome ‘meathook’ murders of Afrikaner farmers Koos and Retha van Zyl, 63 and 66, on their farm Poortjie between Senekal and Steynsrus on Jan 7 2010.
“Where are the news media today? Where are the TV-cameras? If a farmer were to kill a farm-worker, there would at least have been government ministers at the court today. But murders of farmers are just too commonplace,’ said Fanie Ferreira, chairman of the Emdonia farmers’ cooperative. He said there is a strong feeling of dismay among the farmers. “Those guys are angry,’ he said.
Appearing in court were two black South African citizens, Ndaba (29)and Pule Jacob Mpanyane (22) on charges of armed robbery, motor vehicle theft, livestock theft and the double murder of the Van Zyl couple. They were not asked to plead, the case was postponed to 1 February 2010 while the suspects would be seeking legal-aid assistance. They remain in police custody until their bail-application hearing.
The Van Zyl couple were assaulted most cruelly with a meathook before they were shot dead with their own shotgun before fleeing in the couple’s daughter’s car. Alert police officers spotted the car, which had been reported stolen, and arrested the two suspects. http://www.beeld.com/Content/Suid-Afrika/Nuus/1928/89d07c7f2d4b405e837be3ef2541b315/08-01-2010-12-38/Boer,_vrou_geskiet_n%C3%A1_vleishaak-houe
Ferreira said the worst part of the tragedy was to witness the suffering of the couple’s daughters. Estie, a Ventersburg teacher and younger daughter Marietjie, a candidate-lawyer in Bloemfontein, were also present at the court. Their brother Erik was expected to arrive soon from the United States of America, where he works, they said. The couple’s burial takes place from 11am on Tuesday on the farm Bethsaida. A memorial service will be held at 12:00 at the NG (Dutch-Reformed) Church North, opposite the Paul Erasmus Afrikaans High School in Senekal, and will be led by Rev Pieter van Heerden, said the family in an interview with Volksblad newspaper.
- Local provincial MEC Thabo Manyoni, who holds the province’s policing and security portfolio, said ‘the gruesome murders of the Van Zyl farm couple and of three-year-old Onele Galada in Thabong both on Christmas Day, were due to moral decay’. Manyoni visited the girl’s family on New Year’s Day and handed them food-parcels. He did not visit the family of the murdered farm-couple. http://www.volksblad.com/Content/Suid-Afrika/Nuus/2114/22cb0da821d84605847d51694aaa05e3/09-01-2010-05-33/LUR_skryf_wrede_moorde_toe_aan_morele_verval_ http://www.beeld.com/Content/Suid-Afrika/Nuus/1928/ef6ae0259840479d8107ebdd0f1d1a0f/09-01-2010-01-33/Vleishaak-aanval_Ontstelde_boere_ruk_op_by_hofverskyning

Groote Schuur electrician raises hell about filth
Suspended electrician at Groote Schuur Hospital, Cape Town -- Johan Beaurain -- raised stink about blocked toilets on C and D level…
-
and other health and safety problems…
He describes his battle with hospital management to try and get routine maintenance carried out, and his fight to clean up ‘the many dysfunctional, filthy, blocked toilets throughout the hospital and other health and safety issues. He describes a ‘culture of fear amongst the workers and victimization by the managers’, and claims that for instance, blocked, overflowing toilets are spreading excremental fumes via the airconditioning system.
The teaching hospital has 3,663 staffers, caring for more than 560,000 referrals and inpatient admissions per year. It can be reached for comment at telephone 021 404 2187/8, fax 021 404 3254, email gshproffice@pgwc.gov.za contacts: Mr A Jacobs or Mrs A Alexander
Mr Beaurain writes:
“My name is Johan Beaurain and I live at Lower Collingwood Road, Observatory, Cape Town. I am an electrician at Groote Schuur Hospital, Observatory, Cape Town. I solemnly affirm the facts stated herein to be true to the best of my knowledge and belief.
When I started work at the hospital in June 2006, I noticed several health and safety problems in the workplace. The main problems were related to the lack of routine maintenance on services such as air-conditioning, water, sanitation and electricity that impacts on the health and safety of the patients and staff. I brought some of the problems to the attention of the management, but I was ignored and ridiculed.
“I discussed the health and safety problems with some of my colleagues who told me that they have already tried to get the management to attend to the problems but they were always frustrated by the authoritarian management style of their seniors.
Management of Groote Schuur far more eager to outsource contracts to private contractors…
“I soon learned that the management is not at all eager to establish proper routine maintenance programs. The management appeared to be far more eager when facilitating outsourced contracts in relation to private contractors. I am often requested to perform work related to an outsourced contract that I suspect a contractor is getting paid to do.
“Because I was initially still working in a temporary capacity I decided to take a cautious approach to try and correct the problems that existed in my workplace. I decided to try and channel my ideas through my union in the hope that the problems could be addressed collectively as part of a skills training and development programme focused on providing people with the skills and development that we will need to resolve problems in the workplace.
Culture of fear
“My efforts were frustrated at every level. It soon became clear to me that the hospital is plagued by a culture of fear amongst the workers and victimization by the managers. . As time moved on my approach to the problem also started changing. Gradually it became a far more rigorous approach in an attempt to get the problems addressed. I started submitting several written grievances about specific problems that I encountered. I realised very well that I am exposing myself by acting on my own, but I was hoping that along the way I will be able to gain the support of some of my colleagues so that the transformation of the hospital could become a collective effort.
“The management frustrated most of my grievances by either failing to respond, or failing to respond appropriately. They also retaliated by making my life very unpleasant in the workplace. It became clear to me that they are victimising me, trying to drive me out of the workplace. Eventually I managed to get some of the issues that I highlighted stated in the form of an unfair labour practice complaint before an arbitrator appointed by the bargaining council. “
-----------------
Picture: John Beaurain also wrote to the Western Cape Public Prosecutor about what he saw as the ‘illegal use of HIV-testing materials.’ The prosecutor wrote that ‘it would be nearly impossible to prove the allegations in your letter in a court of law’. He was advised to raise the issue with the Treatment Action Campaign instead.
-----------------
“My union representatives never arrived to represent me at the arbitration hearing and I was obliged to represent myself. At the time I was a member of NUPSAW that was the biggest union at my workplace. (I have since resigned from NUPSAW and I signed up with NEHAWU.)
“The arbitrator refused to listen to my complaints, claiming that he does not have jurisdiction to do so. I suspected the whole procedure had been rigged and I also suspected the arbitrator to be in cahoots with the management. I was also very suspicious about the absence of my union representatives. At one stage I packed my documents up, preparing myself to walk out of the room. But the arbitrator then called me back after which he then started with the actual arbitration hearing.
“When I received his ruling a few weeks later, my worst fears were confirmed. He distorted almost everything that was presented to him at the arbitration hearing. I became very demoralised, so much so that I realised that I am unable to continue with my normal duties as an electrician. I then approached Dr. Helga Antonissen, the ‘Staff Health Doctor’ at Groote Schuur Hospital to book me off for a few days so that I could try and get over the extreme frustration that I was experiencing.
“Dr. Antonissen refused to book me off duty. She asked me for the documentation related to my arbitration case so that she could pursue the health and safety issues related to the complaints. I then had to approach Dr. Roberts, a general practitioner in private practice, who agreed to book me off duty for a few days.
On 28 April 2009 I wrote a letter to Dr. Helga Antonissen the ‘Staff Health Doctor’ at Groote Schuur Hospital. A copy of this letter is attached and marked annexure ‘A’: https://docs.google.com/Doc?docid=0AfohhOEe3ZeNZHQ2ZzlwNl8zMzVmdzg5Zm5qNQ&hl=en_GB
Shortly thereafter I also started publicising this matter on facebook: http://www.facebook.com/notes/johan-beaurain/vrotspul-in-groote-schuur-hospitaal/90049268831
By now I was fully aware of the fact that if I wanted the hospital authorities to attend to the health hazards that I have highlighted, I will not only have to blow the whistle on them, but I will also have to keep on blowing the whistle until they respond appropriately.
I received a response from Dr. Helga Antonissen. Her response was dated Fri, Jun 5, 2009 at 11:20 AM. A copy of this letter is attached and marked annexure ‘B’: http://docs.google.com/View?id=dt6g9p6_357gg6dd6sb
“The majority (of toilets on C and D level) were still blocked and stinking both of excrement and chemicals poured over it…. “
On 8 June 2009 I had another look at the toilets on C and D level in the new building of Groote Schuur Hospital and discovered that the majority were still blocked and stinking both of excrement and chemicals poured over it. I took more photographs. A copy of these photographs is attached marked annexure ‘C’: http://picasaweb.google.com/johanbeaurain/20090608?feat=directlink#
On 12 June 2009 I wrote Mr. Harold Scott a second letter about the problem of the blocked toilets and enclosed my photographs taken on the 8th. A copy of this document is attached marked annexure ‘D’: http://docs.google.com/View?id=dt6g9p6_351f4qgqkd7
Still the toilets remained blocked and foul smelling throughout the hospital via the air-conditioning system.
On Wednesday 17 June 2009 I received a memorandum from Mr. Harold Scott that was dated 12 June 2009. A copy of this document is attached marked annexure ‘E’: http://www.facebook.com/photo.php?pid=4865720&id=539320972&view=all&subj=104721628831&aid=-1&oid=104721628831&saved#/note.php?note_id=104721628831
On 24 June 2009 I wrote to Mr. Scott: http://docs.google.com/View?id=dt6g9p6_352hm2ds3dh In this letter I mentioned to Mr. Scott:
‘Instead of seeing to it that the toilets were unblocked and restored to working order to remove the public health hazard that I brought to your attention, you responded by writing me a letter falsely accusing me of trying to bring Groote Schuur Hospital into disrepute; demanding that I cease publicizing the problem; and threatening me with a disciplinary investigation with a view to punitive sanctions against me. Your intention was evidently to intimidate me into silence in this matter. I have taken legal advice and have been advised by counsel that my public disclosure of your failure to maintain the hospital sewerage system in hygienic condition is protected by the Protected Disclosures Act, Act 26 of 2000.’ A copy of the letter that I wrote Mr. Harold Scott is attached marked annexure ‘F’
Initially Mr. Scott acknowledged receipt of my letter with an email dated 25 June 2009. His email said: ‘Your comments and opinion are noted.’ On Friday the 7th of August 2009 Mr. H. Scott gave me another letter . A copy of this letter is attached marked annexure ‘G’: http://picasaweb.google.com/johanbeaurain/BriefVanafMnrHaroldScottReceivedOn07August2009?feat=directlink#5367899181214881058
I then wrote a further correspondence dated 11 August 2009. A copy of this document is attached marked annexure ‘H’: https://docs.google.com/Doc?docid=0AfohhOEe3ZeNZHQ2ZzlwNl8zNTRkemI1dHdycw&hl=en_GB
Warned hospital managers about health and safety issues on 20 Oct 2009:
On 20 October 2009, I emailed links to the previous correspondence regarding Health and Safety issues at Groote Schuur Hospital to managers at Groote Schuur Hospital. I also copied this document to some of my colleagues that attended the previous ‘Occupational Health and Safety Advisory Committee’ meeting. A copy of this email is attached marked annexure ‘I’: http://docs.google.com/View?id=dt6g9p6_377dnrjv6dp
I mentioned to them that I could see no evidence (in the minutes of the previous meeting) that my letter to Dr. H. Antonissen were ever tabled at this official Health and Safety structure of Groote Schuur Hospital. I mentioned to them that I will appreciate it if they could ensure that the matters do receive attention at the next ‘Occupational Health and Safety Advisory Committee’ meeting that was scheduled for Friday 23 October 2009.
A copy of the ‘Meeting Notes’ dated Friday 24 July 2009 is attached marked annexure ‘J’: http://picasaweb.google.com/johanbeaurain/MEETINGNOTESOCCUPATIONALHEALTHANDSAFETYADVISORYCOMMITTEE?feat=directlink#
- Dr. Saadiq Kariem then responded saying: ‘It is inappropriate that you place internal correspondence on what appears to be a public site.’ A copy of the response that I received from Dr. Saadiq Kariem is attached marked annexure ‘K’: http://docs.google.com/View?id=dt6g9p6_378f9wfp4hd
I then replied to Dr. Saadiq Kariem that I disagree with him about that. I said:
- ‘The public have got every right to know about how we are failing to provide them with the services that they are entitled upon. I inspected (on 21 October 2009) the 15 toilets that are hidden away in the service levels of Groote Schuur Hospital and I discovered that the management have now given instructions for these filthy toilets to be locked up. Locking these filthy toilets up will not solve the problem with lack of hygienic conditions in Groote Schuur Hospital. The rotten air around these filthy toilets will still escape to be pumped into the wards via the air-conditioning system. I was hoping that you would see to it that they fix these toilets up so that the waste can be flushed away on a regular basis. When the workers that must work in the service levels do not have access to a toilet to relieve themselves, they will have little option but to look for a dark corner to do so. I accidentally stepped into such a mess one day whilst I was trying to find my way in the pitch-black darkness of a plant room. Why are you allowing your managers to lock these filthy toilets up whilst there is clearly a need for these toilets to be working properly and for these toilets to be kept in a clean and hygienic condition?’ A copy of this email that I wrote to Dr. Saadiq Kariem is attached marked annexure ‘L’: http://docs.google.com/View?id=dt6g9p6_397c3wwfj6w
Mr. Harold Scott also responded minute’s later saying: ‘The plan is to repair the toilets and then lock them up. Each contractor working in an interfloor area will be issued with a key to a dedicated toilet for which he will be responsible. At the end of his contract he must hand back a clean, working toilet.’ A copy of this response that I received from Mr. Harold Scott is attached marked annexure ‘N’: http://docs.google.com/View?id=dt6g9p6_379m2kcdpf3
According to the information that I received, representatives from labour did then raise the issue at the ‘Occupational Health and Safety Advisory Committee’ meeting that took place on Friday the 23rd of October 2009. Apparently the management of Groote Schuur Hospital was unable to provide them with a progress report regarding the issue.
The matter was then discussed at a subsequent ‘Labour Caucus’ meeting at which meeting they then decided to distribute a petition regarding this matter. As soon as I learnt about it from Mr. Mziwandile Nongalaza, I immediately started distributing hard copies of this petition throughout the hospital. A copy of this petition is attached marked annexure ‘O’.At a later stage I also wrote up an online version of this petition: http://www.petitiononline.com/GSH/petition.html
On World Aids Day, Tuesday the 1st of December 2009, I published the following document on Facebook: ‘QUESTIONS FOR THE PRESIDENT OF SOUTH AFRICA ON WORLD AIDS DAY – 1 DECEMBER 2009’: http://www.facebook.com/note.php?note_id=206096483831
A copy of this document is attached marked annexure ‘P’. On the same day I also distributed hard copies of this document amongst the staff working in the hospital.
The staff health doctor, Dr. Helga Antonissen, objected when I gave her a copy. This incident happened between 11h00 and 12h00 on 1 December 2009. Dr. Helga Antonissen was standing in the corridor on E-level listening to one of the choirs singing there during the AIDS day activities. She appeared to be one of the organisers in charge of the AIDS DAY activities in the hospital. Dr. Helga Antonissen said she does not want the pamphlet. She then started shouting at me, asking me what the pamphlet is about. I said she should read the pamphlet because it is some questions that I am posing to the President of South Africa.
She said if it is about ‘denialism’ then she do not want it. She shoved the pamphlet back at me. I turned away and walked away from her. She approached me again shouting in my face and asking me if I have permission to distribute the pamphlet. I said. ‘No, I do not need your permission.’ She then asked if I have permission from the hospital. I then told her that I need nobody’s permission.
Shortly after this incident my superintendent Mr Davids came to fetch me in the new hospital. The time was round about 12h45 by then. He called me to the Engineering Department where he gave me a letter that was signed by Mr. Scott, saying that I should respond before 15h00 on that same day about why I did not adhere to a previous written warning not to publish health and safety matters related to the hospital on facebook. A copy of this letter is attached marked annexure ‘Q’: http://picasaweb.google.com/johanbeaurain/20091205?feat=directlink#5411697308276442834
We (two of my shop stewards and I) approached Mr. Scott before 15h00 to discuss the matter. But by then he had left the workplace already. Mr Davids said Mr. Scott is in a meeting and that Mr. Scott told him that I should make my representations to him (Mr. Davids).
Suspended December 2 2009
They then suspended me from my workplace at round about 15h30 on Wednesday the 2nd of December 2009. They said that I am suspended because I am refusing to adhere to a ‘lawful instruction’ to cease publishing health and safety matters related to the hospital on facebook. They also accused me of distributing the toilet petition in the hospital. They said this was also unlawful. The suspension letter can be seen online. A copy of this suspension letter is attached marked annexure ‘R’: http://picasaweb.google.com/johanbeaurain/20091221?feat=directlink#
At first I refused to recognize the suspension. I went back to work on Thursday 3 December 2009. Later that day whilst I was in a meeting where the head of my department, Mr Harold Scott, was addressing the workers during a ‘General Meeting’ of his department in the tearoom at the Engineering Department, the management then called the hospital security, as well as some contract security staff to remove me from the premises of the hospital. The General Meeting then disintegrated into chaos as a result of the arrival of the security officers on the scene.
We (two of my shop stewards and I) then met with the management in Mr. Scott’s office. This meeting took place immediately after they called the security to remove me from the workplace. Present in this meeting was Mr. Harold Scott (Head of Engineering Department), Mr. Nazeem Hermans (NUPSAW Shopsteward), Mr. Sam Mfamana (Head of Security), Mr Mziwandile Nongalaza (NEHAWU Shopsteward), Ms Constance Kgosana (NEHAWU Shopsteward) and I. I then told Mr. Scott that the suspension is nonsense and that it is invalid and that they should say who is behind the suspension.
My departmental head Mr. Harold Scott then claimed that he was instructed to suspend me. He said the instruction came from Human Resources. He said that his position was that I would do more harm to Groote Schuur Hospital when I am off the premises of the hospital than what I would do whilst on the premises. But that he was defeated by the rest of the management when they decided to suspend me in any way.
I told Mr. Scott that I acknowledge publishing the information as I am standing accused. But that I am not happy with the accusations as I am regarding it as my public duty to highlight such conditions until they are corrected and that I intend to continue publicising the conditions until these conditions are corrected or rectified as it is my right and duty to do so.
Mr. Harold Scott then said that I must remember that I rubbed a lot of people up the wrong way and that these people are now angry with me. He mentioned Dr. Helga Antonissen by name.
One of my shop stewards Ms Constance Kgosana challenged Mr. Scott in this meeting about the fact that he is sitting in his office every day and that he is doing nothing to see to it that the harmful and dangerous health and safety conditions that were pointed out to him are being attended to. Ms Constance Kgosana is a colleague of mine who is working with me at the ‘Electrical Component’ of the Engineering Department. Mr Scott then pointed out that he is not working with toilets and that his responsibility is mainly to provide strategic management.
Mr. Scott continued to argue that Ms. Tracey Douglas is the person responsible for ensuring hygienic conditions in the hospital and that the staff from the Engineering Department must only respond to pink requisition forms that is requesting specific repairs to a specific toilet.
‘Blocked, disfunctional toilets throughout the hospital’
‘It was pointed out to Mr. Scott that there are blocked toilets throughout the hospital. The doors of most of these toilets are locked, and with some it has been made impossible to open the door of the toilets. This was probably done to try and obscure the filthy conditions that exist inside these toilets.
- Mr. Scott insisted that it is not his responsibility to see to it that the workers in the Engineering Department attend to conditions like the many dysfunctional toilets in the hospital.
On Friday morning 04 December 2009 I was informed by my shop stewards Mr. Mziwandile Nongalaza and Ms Constance Kgosana that the labour relations manager claimed that the instructions to suspend me came from the provincial offices of the Health Department in Cape Town.
Mr. Mziwandile Nongalaza also informed me that Mr. Sam Mfamana, the ‘Head of Security’ at Groote Schuur Hospital, told him earlier that morning that he received instructions to remove me from the premises.
I told Mr. Mziwandile Nongalaza that I will comply with the decision of my union if they were to decide that I should adhere to suspension documents that I was given. He then consulted telephonically with Ms Constance Kgosana after which we jointly decided that I should rather leave the premises. I then left the premises of my workplace at about 11h40 on Friday 4 December 2009. I asked Ms Constance Kgosana to convey my decision to the management. I am still very bitter about it.
I respectfully request that the Public Protector investigate the situation and protect me from further victimisation by the hospital authorities for the steps that I have taken in the public interest to get the health hazards resolved.
