Johannesburg Equality Court. "Words are powerful weapons that could lead to disastrous actions and even genocide”, Judge Collin Lamont said on Monday 12 September 2011. He ruled ANC youth league Julius Malema guilty of hatespeech in the civil case.
"The words of one person inciting others...that's how a genocide can start," he said in handing down judgment in a hate speech case against ANC Youth League president Julius Malema. Lamont said in determining the outcome of this case the court had to analyse the meaning of the words in the "shoot the boer" song, and its effect on society. Single words and a group of words had "elastic meanings". The words Malema sang had not been forgotten as they were derogatory and hurtful.
He said the response of the public was relevant to check the entirety of its context.
Genocide was defined as "the deliberate and systematic destruction" of an ethnic, religious, or national group.Lamont likened the songs by Malema 'as those sung by soldiers when they were at war. Soldiers in battle don't treat the enemy as individuals but as a thing [a unit]." Lamont said the difference was that soldiers were singing to celebrate.
A video of Malema singing "shoot the boer" was shown during his hearing.
"He executed rhythmic movement... making the shape of a firearm... and certain gestures were made," said Lamont. An armed person was one in power and one who intimidated, the court found. The court heard that the Constitution provided for equality, and the eradication of social and economic inequalities. South Africa had international obligations under the United Nations for peace and unity including the elimination of all forms of racial discrimination, and discrimination against women.
Malema was not in court, even though his disciplinary hearing before the ANC was put on hold for Monday to allow him to attend proceedings. Outside court, a small group gathered to show their support for Malema. "We will follow Malema anywhere," one of them said. A police officer said there had been no application for a gathering permit but police had prepared for a "spontaneous gathering".
AfriForum Youth, which is part of the rights lobby group AfriForum, opened a civil case against Malema in the Equality Court after he sang the words "dubhula ibhunu", which translate to "shoot the boer", at a number of ANC Youth League gatherings last year. It believed the words were threatening to minorities, a threat to the safety of Afrikaners and farmers, and that the phrase was hate speech.
Malema and five other seniors in the league are in the midst of an ANC disciplinary hearing over comments they had made that the party believed was bringing it into disrepute.At the opening of the disciplinary hearing, groups claiming to be Malema supporters threw stones and bottles in the Johannesburg CBD and harassed media.

From April 2010, the ruling African National Congress party’s youth league started defying a Gauteng High court order by publicly singing the banned genocidal hate-speech song 'Shoot the Boer’ and “Kill the Boer, starting' from an ANC platform at the regional elections in Mthatha in the Eastern Cape province . And as is often done by ANC-cadres at public events, the youth leader also frequently made impromptu adjustments to the lyrics, singing 'Dubula ibhunu” (Shoot the Boer)' and then very sarcastically adding: 'Kiss the Boer'. He also detailed the gruesome sexual-mutilation tortures which are endured by many of the Boer victims, emotionally describing the horrific sexual-torture deaths of Alice and Helen Lotter in the Free State on Dec 6 2008 (pic above left). The words 'Kill Boer' were scrawled on the walls of their homestead... They were tortured for 4 hours - and they were hacked so many times with glass shards that forensic examiners were unable to find any intact tissue from their wombs.
South Africa rapidly heading for famine because of ethnic-cleansing of their only food-producers:
Pretorius also warns that if black South Africans continue to chase their only food-producing farmers off the land, the country is rapidly heading for famine:
- “In South Africa we are heading for famine, yet the very people who can prevent that, the commercial farmers who produce the only excess food, are being pushed off their lands: the Boer farmers now occupy less than one percent of the total surface-area of the country. In 1994 there were 85,000 Boer farmers, now there are less than 12,000…’
He points out that Boers are not only being attacked in large numbers, but also are suppressed politically and economically and that all the Boers’ legal rights are being taken away. “Eleven members of the Boeremag have been in jail, innocently, for the past eight years now. So-called trial-awaiting prisoners. The last time they had a proper hearing was in August last year. Meanwhile these 11 people have been sitting in a jail as ‘trial awaiting prisoners’ in other words they are innocent until proven guilty - and that case could still carry on for another two years. So they would have imprisoned for ten years, totally innocent. Our justice system is clearly deteriorating by the day…’
